The law has nuances both\u00a0in the country of birth\u00a0and in Sweden,\u00a0and\u00a0it\u2019s\u00a0our job to give parents the advice and support to get through this, but it does require\u00a0patient.<\/p>\n\n\n\n<p>Typically, I have a meeting with them about three months before\u00a0the\u00a0due date to discuss the requirements.\u00a0As well as answering questions,\u00a0it\u2019s\u00a0about making sure they understand that things can take time, while also reassuring them that they\u00a0don\u2019t\u00a0need\u00a0to worry,\u00a0I will\u00a0help them with the legal process in Sweden.\u2028\u2028\u2028\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>How much is handled by the agency and how much is the responsibility of the intended parents?\u00a0<\/strong><\/h2>\n\n\n\n<p>The agency handles the interaction\u00a0between the parents to be and\u00a0the clinics in\u00a0the different\u00a0countries\u00a0and the surrogate mother.\u00a0It\u2019s\u00a0up to give me the birth certificate and to register their child with the tax office and social services.\u00a0As\u00a0a\u00a0legal adviser,\u00a0I support parents in Sweden, as far as my remit allows\u00a0which includes\u00a0establishing\u00a0fatherhood,\u00a0and\u00a0filing for sole custody,\u00a0and adoption.\u00a0\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>How does Swedish law view children born through surrogacy in countries where surrogacy is legal?<\/strong>&nbsp;<\/h2>\n\n\n\n<p>Currently, Sweden&nbsp;doesn\u2019t&nbsp;recognize surrogacy, but it does recognize a child\u2019s closeness to family and the right to know&nbsp;their&nbsp;identity. This means that in those relationships where there is a father, the starting point is&nbsp;establishing&nbsp;fatherhood and&nbsp;later&nbsp;sole custody. The ease of this will depend on the process and documents issued in a specific country.&nbsp;In the US, for example, the child can travel home with a US issued passport, while children born in Georgia need to wait for the Swedish court to&nbsp;establish&nbsp;fatherhood before any documents can be issued by the Swedish Embassy.&nbsp;<\/p>\n\n\n\n<p>Once the Swedish court has awarded sole custody to a father, the other partner is able to file for adoption through the courts. The&nbsp;law is there to protect the child and primary to that is the child\u2019s right to belong in a unit,&nbsp;i.e.&nbsp;as part of family.&nbsp;Obviously,&nbsp;the process will differ if&nbsp;you are a&nbsp;single&nbsp;mother&nbsp;or female couple, but we have a process in place for supporting them too.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What legal steps should\u00a0intended\u00a0parents complete\u202fbefore\u202fbirth to avoid complications later?\u00a0<\/strong>\u00a0<\/h2>\n\n\n\n<p>The most\u00a0important step\u00a0is being registered as living in Sweden. The laws differ depending on where you are in Northern Europe, so your residency will be key when dealing with the different government agencies\u00a0and courts. Tammuz has\u00a0been doing this for a long time in the region so\u00a0with\u00a0their support network you can trust in the process even though it takes time.\u00a0\u00a0<br>\u00a0<br>You can read more about how new Danish legislation has brought parity to biological and non-biological surrogate parents\u00a0<a href=\"https:\/\/www.tammuz.com\/new-danish-legislation-brings-parity-to-biological-and-non-biological-surrogate-parents\/\" target=\"_blank\" rel=\"noreferrer noopener\">in this blog<\/a>\u00a0by Mikkel Raahede.\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What misconceptions do intended parents often have about surrogacy law that\u00a0you\u2019d\u00a0like to correct?<\/strong>\u00a0<\/h2>\n\n\n\n<p>Again,\u00a0I would say that\u00a0it\u2019s\u00a0expecting\u00a0to be the sole custodian of the child at birth as opposed to the surrogate.\u00a0Despite the fact that\u00a0it may be the egg of one parent\u00a0or a separate donor, or\u00a0the sperm from\u00a0one parent,\u00a0Sweden\u00a0still recognizes\u00a0the person who gives birth as the mother. And\u00a0that\u2019s\u00a0why\u00a0we\u2019re\u00a0here to support intended parents through the\u00a0process\u00a0of\u00a0becoming recognized by the Swedish state as the legal parents,\u00a0just like\u00a0parents of\u00a0any\u00a0child in Sweden.\u00a0\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Anything else?\u2028<\/strong>\u00a0<\/h2>\n\n\n\n<p>Having worked with\u00a0surrogacy\u00a0for some years now,\u00a0I believe we\u00a0need a change in the legal system. Rather than\u00a0looking at\u00a0surrogacy as a business,\u00a0the laws\u00a0should focus more on the child\u2019s best interests.\u00a0Making it easier to\u00a0establish\u00a0parenthood is one way of doing that. Choosing to do surrogacy is not a casual\u00a0decision,\u00a0starting a family rarely is.\u00a0It\u2019s\u00a0a\u00a0highly involved\u00a0process\u00a0for those who choose to take the surrogacy\u00a0route.
